Clean Air Council v. Pruitt
Petitioners challenged the EPA's decision to stay implementation of portions of a final rule concerning methane and other greenhouse gas emissions. The DC Circuit held that, although absent a stay, it would have no authority to review the agency's decision to grant reconsideration, because EPA chose to impose a stay suspending the rule's compliance deadlines, the court must review its reconsideration decision to determine whether the stay was authorized under section 307(d)(7)(B) of the Clean Air Act (CAA), 42 U.S.C. 7607(d)(7)(B). Ames v. DHS
Plaintiff filed suit against DHS and DOD under the Privacy Act, 5 U.S.C. 552a, after a DHS agent sent an Inspector General's report regarding plaintiff to DOD. The DC Circuit held that DHS's disclosure of the report to DOD was permissible under the Act because the disclosure constituted a "routine use" of the record where the purpose of DHS's disclosure of the Inspector General's report to DOD was compatible with the purpose for which the report was collected, and DHS's disclosure of the report met the requirements of DHS routine use notice. In this case, DHS’s purpose in collecting the report was to determine whether plaintiff had committed wrongdoing that could affect her suitability for federal employment, and the disclosure met the requirements of Routine Use G and Routine Use H. Seminole Electric Cooperative v. FERC
The Commission determined that Florida Power overcharged Seminole for electricity and ordered a refund. Seminole petitioned for review, claiming that it was entitled to a larger refund. The DC Circuit denied the petition for review, holding that the Commission correctly concluded that the service agreement required Seminole to make any challenge to a bill within 24 months of receiving that bill, and thus limited Florida Power's refund liability. The court also held that, in the face of ambiguity, the Commission reasonably concluded that the tariff allowed transmission providers to use non-apportionment. View "Seminole Electric Cooperative v. Center for Biological Diversity v. EPA
Conservation Groups filed a complaint in the district court under the citizen suit provision of the Endangered Species Act (ESA), 16 U.S.C. 1531 et seq., and a petition for review in the DC Circuit pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. 136 et seq. The court granted the Conservation Groups' petition, holding that FIFRA grants the court of appeals exclusive jurisdiction to review an ESA claim that is "inextricably intertwined" with a challenge to a pesticide registration order. Masters Pharmaceutical, Inc. v. DEA
Masters filed suit challenging the DEA's 2014 decision to revoke the company's certificate of registration, without which it cannot sell controlled substances. The DC Circuit denied the petition for review, holding that the Administrator's conclusions -- that whenever an order for controlled substances was held by the SOMS Computer Program, that order was presumptively "suspicious" under 21 C.F.R. 1301.74(b), and Masters' employees rarely undertook the investigation required to dispel the suspicion surrounding held orders -- were well founded. Louisiana Public Service Commission v. FERC
LPSC petitioned for review of FERC's rejection of LPSC's request to reform certain depreciation rates. The DC Circuit denied the petition for review and rejected LPSC's claim that FERC failed to confront its asserted evidence of undue discrimination where FERC fulfilled such obligations; FERC precedent did not require the use of FERC's own depreciation standards; and there has been no unlawful subdelegation because FERC has exercised, and intends to continue to exercise, its authority. Millennium Pipeline Co. v. Seggos
Millennium petitioned to compel the New York State Department of Environmental Conservation to act on Millennium's application for a water-quality certificate. The DC Circuit dismissed the petition for review, holding that, even if the Department has unlawfully delayed acting on Millennium's application, its inaction would operate as a waiver, enabling Millennium to bypass the Department and proceed to obtain approval from FERC. Advanced Energy Management Alliance v. FERC
Petitioners challenged the Commissions' approval of revisions to the rules governing the buying and selling of "capacity" for markets operated by PJM. The DC Circuit held that the Commission balanced the benefits of the revised rules against the increased costs and reached a reasoned judgment. Therefore, the Commission's decision was not arbitrary nor capricious. The court deferred to the Commission's interpretation of the Federal Power Act, 16 U.S.C. 824e, because its interpretation of the Act's requirements was reasonable; deferred to the Commission's balancing of competing concerns in setting a penalty rate; and rejected challenges to the default offer cap, the year-round capacity commitment, orders approving PJM's demand resource rules, and imposition of Capacity Performance penalties on resources that fail to perform due to unit-specific constraints. United Airlines, Inc. v. TSA
Petitioner sought refunds from TSA for overpayments it made to TSA that related to fees charged to airline passengers that fund aviation security expenses and were to be remitted to TSA. TSA conducted an informal adjudication and refused to consider the refund request. The DC Circuit rejected the notion that petitioners' request for a refund was a tardy effort to reopen an audit. Putting aside the audit as irrelevant, there still remained the question of whether it was arbitrary and capricious for the Under Secretary to refuse to pay a refund, as he was statutorily authorized—but not commanded—to do. Galvin v. United States
Plaintiff and her husband filed suit under the Federal Tort Claims Act (FTCA), 28 U.S.C. 1346(b)(1), 2671-2680, against the government after she suffered severe injuries in her diplomatic housing when stationed overseas in Haiti. The DC Circuit affirmed the district court's dismissal of the suit because plaintiffs' action fell within an exception to the FTCA's waiver of sovereign immunity for injuries arising in a foreign country. Even assuming without deciding that all overseas diplomatic housing should receive the same treatment under the FTCA as a United States embassy, plaintiffs' claim was foreclosed by circuit precedent. In Macharia v. United States, 334 F.3d 61, 69, the court concluded that the FTCA's foreign country exception applied to injuries occurring at a United States embassy. View "Galvin v.
